TERMS AND CONDITIONS FOR DIGITAL MARKETING COACHING & CONSULTING PLANS

These Terms and Conditions (“Agreement”) govern your purchase and use of digital marketing coaching and consulting services (“Services”) provided by Shelley's Social Media, LLC (“Company”, “we”, “our”, or “us”). By purchasing a digital marketing coaching or consulting plan, you (“Client”, “you”) agree to the following terms. If you do not agree, do not purchase or use our Services.

1. Services Provided

Shelley's Social Media will provide personalized coaching and consulting services related to digital marketing. These Services may include, but are not limited to:

  • SEO strategy and audits

  • Google Business Profile optimization

  • Funnel building and lead conversion strategy

  • Email marketing (setups, campaigns, automations)

  • PPC/ads guidance (Google, Meta, etc.)

  • Analytics training (Google Analytics, Search Console, etc.)

  • Website usability and CTA guidance

  • Competitor analysis and digital positioning

Each session is designed to address the Client’s unique business needs and goals.

2. Payment & Billing

(a) Plans and Billing Frequency

  • Jumpstart Plan: Billed weekly

  • Growth Plan: Billed monthly

  • Pro-Level Plan: Billed bi-weekly

(b) Payment Terms

All payments must be made in full prior to receiving services. Payments are non-refundable and due before the start of each billing cycle. If payment is not received on time, services will be paused until the account is brought current.

3. Scheduling & Cancellations

(a) Scheduling
Clients are responsible for scheduling their sessions via our online scheduling system. A link will be provided upon purchase.

(b) Cancellation Policy
At least 24 hours’ notice is required to cancel or reschedule any session. Sessions canceled with less than 24 hours’ notice are forfeited and will not be refunded or rescheduled.

(c) Rescheduling
Reschedules must occur within the timeframe of your current plan and are subject to availability.

4. Client Responsibilities

(a) Implementation
You are responsible for executing the strategies discussed during coaching. Our role is to provide guidance, structure, and recommendations—but implementation is in your hands.

(b) Access
To make the most of your sessions, you may be asked to share access to analytics platforms, ad accounts, email software, or website backends. Declining to provide access may limit the scope of support.

5. Support Between Sessions

All coaching plans include limited support via email and text messaging between sessions. This support is for quick questions, check-ins, or clarification—not for full coaching or strategy work.

Support access and frequency are determined by your selected plan:

  • Jumpstart Plan:
    Includes up to 2 email responses and 2 text replies per week.

  • Growth Plan:
    Includes up to 3 emails and 3 text replies per month.

  • Pro-Level Plan:
    Includes up to 6 emails and 6 text replies per month.

Response times may vary but will typically be within 1–2 business days. Unused support does not roll over. If support requests exceed these limits, you may be asked to upgrade your plan or schedule an additional session.

6. No Guarantees

While we offer expert-level support, Shelley's Social Media cannot and does not guarantee specific outcomes such as increased sales, leads, or website traffic. Your success depends on many factors outside of our control, including your effort and consistency.

7. Confidentiality & Intellectual Property

(a) Confidentiality
Both parties agree to keep all shared proprietary information, strategy, documents, and business data confidential.

(b) Ownership
All materials created or shared during coaching are the intellectual property of Shelley's Social Media and may not be reproduced, resold, or shared without written permission.

8. Termination & Refund Policy

(a) Termination
Either party may terminate the relationship with written notice. However, any remaining sessions or payments are non-refundable. Sessions not used before termination are forfeited.

(b) Refunds
All sales are final. Missed sessions, last-minute cancellations, or unused sessions within the package timeframe will not be refunded or credited.

9. Limitation of Liability & Governing Law

(a) Limitation of Liability
Shelley’s Social Media is not responsible for any direct or indirect loss arising from use of the Services. Our total liability is limited to the amount you paid for the coaching plan.

(b) Governing Law
This Agreement is governed by the laws of the State of Wisconsin. Any legal matters will be handled in the appropriate courts of Wisconsin.

10. Miscellaneous

(a) Entire Agreement
These terms represent the full agreement between the Client and Shelley’s Social Media. No verbal or outside modifications apply unless signed in writing.

(b) Severability
If any part of this Agreement is found to be invalid, the remaining provisions will continue to apply.

(c) Force Majeure
We are not liable for delays or non-performance due to events beyond our control (natural disasters, tech outages, illness, etc.).

By purchasing any Digital Marketing Coaching Plan, you acknowledge that you have read, understood, and agree to all terms listed above.
